NOTICE INVITING BIDS CITY OF SANTA MARIA, CA SEALED BIDS will be received at the offices of the City Clerk, City Hall, 110 East Cook Street, Santa Maria, California 93454, until 2:00 p.m. Local time, Tuesday, April 11, 2023 at which time they will be publicly opened and read for performing work as follows: Construction of the MUNICIPAL IMPROVEMENTS JOB ORDER PAVEMENT REPAIRS CONTRACT 2023 – 2024, FORMAL BID NO. 2023/05. This is an on-call contract, which shall be used to provide the City with a readily available workforce for repairs to existing street segments and emergency repairs, as the City deems appropriate. In general, the work consists of repair and replacement of hot-mixed asphalt on existing street segments, as required. The work shall be located in the City of Santa Maria. All work will be inspected through the City of Santa Maria. The contract agreement will be for a term of one (1) year with a not to exceed annual funding limit of $2,000,000. The agreement will include an option for an additional one (1) year extension with a not to exceed annual funding limit of $2,000,000. The total term of this agreement will not exceed two (2) years. The amount of work to be requested during the twelve-month contract period cannot be well defined at the outset. Work shall be issued through Work Orders. The City reserves the right to award up to four (4) contracts to a pool of the lowest responsive, responsible bidders. Following Council award of the multiple job order contracts, the City shall prepare drawings and/or specifications of sufficient detail to determine a scope of work and schedule for individual projects. These individual projects shall be offered first to the first low bidder, who will be entitled to perform the work unless the contractor declines the project or the City determines the contractor would be unable to timely and satisfactorily perform the work due to bidder responsibility factors established by City, including but not limited to adequate financial, material, equipment, facility, workforce and personnel resources. Upon such determination by City, the project shall be offered next to the second low bidder, who will be entitled to perform the work unless the project is declined or the City determines that the contractor would be unable to timely and satisfactorily perform the work due to the contractor responsibility factors set forth above. If there are additional on-call contractors, this process would continue as needed until the project is assigned. The City’s determination of non-responsibility under this section may be appealed using the procedures set in these specifications. At the time of the bid opening, the successful Bidder must be legally entitled to perform contracts requiring a Class A Contractor’s license. Any Bidder or contractor not so licensed shall be subject to all penalties imposed by law including, but not limited to, any appropriate disciplinary action by the Contractors' State License Board. The price of the documents is $10.00, which cost is NON-REFUNDABLE regardless of whether the drawings, specifications, and other bidding documents are returned or not. Upon receipt of your payment, the documents will be sent to you using an overnight delivery service. Until further notice, copies of drawings, specifications, and other bidding documents are not available for review at the offices of the City Engineer. Requests for information or clarification must be submitted in writing and received in the Department of Public Works no later than 5:00 p.m. On Friday March 31, 2023. Requests may be submitted via e-mail to: tkorman@cityofsantamaria.org. Bids shall be executed on the forms provided in the book of bidding documents and in accordance with the instructions contained therein. Bid security, in an amount not less than 10 percent (10%) of the total bid dollar amount, is required to be submitted with each bid. The bid security shall be in the form of a bidder's bond or a certified or cashier's check drawn upon a responsible bank made payable to the City of Santa Maria, and conditioned to be forfeited to said City in the event that the bidder, if the bid is accepted, does not enter into a written contract within ten (10) days after the awarding of the contract. The bidder to whom award is made will be required to furnish a payment bond and a faithful performance bond. As required under Contractor's License in the Instructions to Bidders of the bidding documents, bidders shall be licensed as a Class “C-61/D-35”. In addition, the following conditions apply: No contractor or subcontractor may be listed on a bid proposal for a public works project (submitted on or after March 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)].No contractor or subcontractor may be awarded a contract for public work on a public works project (awarded on or after April 1, 2015) unless registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5.This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. Pursuant to Section 1770, and the following, of the California Labor Code, the successful bidder shall pay not less than the prevailing rate of per diem wages as determined by the Director of the California Department of Industrial Relations. A copy of such prevailing rate of per diem wages is on file at the offices of the City Engineer, 110 South Pine Street, Room 221, Santa Maria, California, which copy will be made available for examination at such offices during business hours to any party on request. Pursuant to provisions of Section 22300 of the California Public Contract Code, Contractor may substitute securities for any monies withheld by Owner to ensure performance of the Work. A non-mandatory pre-bid conference is scheduled for 10:00 AM on Monday, March 27, 2023. This conference will allow bidders to review the project specifications.
